Regulations must be followed for installation but are advisable for EICR'S depending on time of install, the main thing is to make sure the property is safe for continued use, so if something doesn't follow the regs but you believe it will be safe to use it's a C3, possibly dangerous is C2, immediate danger is C1.
Whoever sign's the report is responsible for the electrical safety of the future of the property they're testing.
If the socket is directly above the hob or close enough to the sink you believe water could get into it and cause an issue then it would be a C2, if it's around the hob or sink but unlikely to get wet or overheat then it's a C3
Hob regs - 100mm from edge
Sink regs - 300mm from edge (including drain board)

Depending on the IP rating of the product depends on the outcome.
IPx4 and above can be anywhere in the bathroom other than in the bath, anything less can be over 2.25 meters or more than 600mm from the edge of the bath or shower.
